The Party Wall Etc. Act 1996 sets out to protect property owners' interests when a project is required, while at the same time ensuring that the project can continue in a timely manner.

 

The Act requires that when an owner of a property carries out certain works such as digging a foundation within 3m of their neighbour's property, removing a chimney from a party wall, cutting into a party wall for steelwork or building a new wall on the boundary (line of junction), they inform all affected neighbours of their intention by serving the correct notices.

Burnham-on-Crouch has a very special architectural character, with many weatherboarded cottages and historic maritime-related buildings. These structures often lack the robust brick foundations of inland towns, making them particularly sensitive to nearby vibrations. If a neighbour is planning a modern extension with heavy machinery, we often recommend a more rigorous monitoring regime during the works to ensure these lighter, historic structures remain unaffected.

The ground conditions here are heavily influenced by the River Crouch, consisting largely of Alluvium (clay, silt, sand, and gravel). These "soft" deposits are prone to compression. For any project involving new excavations, it is almost certain that the foundations will need to be deeper or more specialized than standard trench-fill. Our expertise in Burnham involves ensuring that these deep excavations are safely shored up so that the "soil of support" for the neighbouring house is never compromised.
